Rules for buying and selling goods in the Delicatum.lt online store
1. General provisions
1.1. These Rules of Purchase and Sale of Goods (hereinafter referred to as the “Rules”), upon approval by the Buyer (after getting acquainted with the Rules and checking the box “I have read the Delicatum.lt Rules and agree with them”), are a binding legal document for the Buyer and the Seller. rights and obligations, conditions of purchase and payment for goods, the procedure of delivery and return of goods, liability of the parties and other provisions related to the purchase and sale of goods in the Delicatum.lt online store.
1.2. The Seller reserves the right to change, amend or supplement the Rules at any time. Buyers who have registered will be informed about any changes, corrections or additions during the login on the Delicatum.lt page and will have to re-approve the Rules. The amendment to the Rules is valid only for those ordered goods that were submitted after the amendment of the Rules. This version of the rules is valid from 2018. September. 29 days and it replaces all previous versions of the rules that were valid for orders in the Delicatum.lt online store.
1.3. In the Delicatum.lt online store, sales are made only in the areas specified in the "Delivery of Goods" section.
1.4. Active natural persons have the right to buy in our e-shop; minors between the ages of fourteen and eighteen, only with the consent of their parents or guardians, unless they are self-employed; legal entities.
2. Protection of personal data
2.1. Delicatum.lt has the right to collect and process personal data provided by the Buyer to Delicatum.lt and, if necessary, to disclose them to third parties when it is necessary for order fulfillment, data processing or Delicatum.lt business planning and analysis. Delicatum.lt also has the right to use the Buyer's personal data for the purposes of advertising and providing information to the Buyer within the limits of Delicatum.lt's activities. The Buyer's data may be used for sending information or other online store activities only with the Buyer's consent (after getting acquainted with the Rules and checking the box "I have read the Delicatum.lt rules and agree with them"). The Buyer has the right to prohibit the collection and processing of his personal data at any time, except when it is necessary for the fulfillment of the requirements arising from the Purchase and Sale Agreement or the fulfillment of the Order. Data about Online Store Buyers and Visitors is protected from loss, unauthorized use and alteration. The data carriers are fully protected from third party access.
3. Entry into force of the purchase and sale agreement
3.1. The agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer, having selected the purchased item (s) and formed a shopping cart, clicks on the link "Pay".
3.2. Delicatum.lt is not obliged to separately notify the Buyer of its consent to enter into the contract. Delicatum.lt is considered to confirm the order from the moment it starts to execute it.
3.3. Each purchase and sale agreement concluded between the Buyer and the Seller is registered and stored in the database of the Delicatum.lt online store.
4. Buyer's rights
4.1. The Buyer has the right to purchase goods in the Delicatum.lt online store in accordance with these Rules and the online store.
4.2. The Buyer has the right to withdraw from the contract of purchase and sale of goods concluded with Delicatum.lt online store, notifying the Seller in writing (by e-mail, indicating the product to be returned and its order number) no later than within 7 (seven) working days from the date of delivery. , except where the contract is for
4.2.1. the supply of audiovisual works and phonograms on any video or audio media, the supply of computer programs and the Buyer has violated the protection of the packaging;
4.2.2. the supply of books, newspapers, magazines or other periodicals;
4.2.3. the supply of cosmetics, perfumery, household chemicals and hygiene goods;
4.2.4. supply of underwear;
4.2.5. goods that have been manufactured taking into account the personal needs of the Buyer or according to the conditions provided by the Buyer;
4.2.6. food products, if a food product of appropriate quality has been sold to the Buyer and the expiration date of the product has not expired;
4.2.7. goods which cannot be returned according to their characteristics, including perishable goods and products which have expired;
4.2.8. in other cases, when the purchase and sale agreement cannot be withdrawn, in accordance with the laws of the Republic of Lithuania.
4.3. The Buyer may exercise the provided right only if the product has not been damaged or its appearance has not substantially changed, nor has it been used. The right of the Buyer provided for in paragraph is exercised in accordance with the farm Minister of State in 2001 August 17 by order no. 258 approved "Rules for the sale of goods and provision of services when contracts are concluded by means of communication".
5. Obligations of the Buyer
5.1. The Buyer must accept the goods in accordance with the procedure established by these Rules and pay the agreed amount for them.
5.2. If the data provided by the Buyer in the registration form changes, he must update them immediately.
5.3. The buyer undertakes not to pass on his login details to third parties. If the Buyer loses the login data, he must immediately inform the Seller about it by the means of communication specified in the "Contacts" section.
5.4. The Buyer, using the Delicatum.lt online store, undertakes to comply with these Rules and not to violate the legal acts of the Republic of Lithuania.
5.5. If the Buyer, at the time of delivery of the goods, refuses to accept the goods without important reasons, the Buyer must cover the costs of delivery of the goods.
6. Seller's Rights
6.1. If the Buyer tries to damage the stability and security of the online store or violates its obligations, the Seller has the right to immediately and without notice restrict or suspend his access to the online store or, in exceptional cases, cancel the Buyer's registration.
6.2. In the event of significant circumstances, the Seller may temporarily or permanently terminate the operation of the online store without notifying the Buyer in advance.
6.3. The Seller has the right to cancel his order without notifying the Buyer in advance, if the Buyer, having chosen the non-cash payment methods, does not pay for the goods within 3 (three) business days.
6.4. When the Buyer chooses the payment method provided in cash at the time of delivery of the goods, the Seller shall contact the Buyer by phone specified in the order in case of any uncertainties regarding the information provided in the order. In this case, the term of delivery of the goods starts from the day of contact with the Buyer. The Seller has the right to cancel his order without notifying the Buyer in advance, if the Seller fails to contact the Buyer within 3 (three) business days.
6.5. Delicatum.lt has the right in all cases not to enter into a Purchase and Sale Agreement with a specific Buyer who has placed an order, including but not limited to cases where the Buyer has withdrawn from the Purchase and Sale Agreement and returned the goods 2 or more times in the last 12 months.
6.6. Delicatum.lt has the right to withdraw from the concluded Purchase-Sale Agreement if the stock of goods specified in the Agreement has run out, as well as if the Agreement was concluded by a person who did not have the right to conclude the Agreement in accordance with these Rules.
7. Obligations of the Seller
7.1. The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the online store Delicatum.lt under the conditions set forth in these Rules and the online store.
7.2. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him and under the conditions specified in these Rules.
7.3. The Seller, being unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer a similar or as similar a product as possible. If the Buyer refuses to accept a similar or most similar product, the Seller undertakes to return the money paid to the Buyer within 3 (three) working days, if the advance payment has been made.
7.4. The Seller undertakes to respect the Buyer's right to privacy to the personal information belonging to him, specified in the online store registration form, except for the cases established by the laws of the Republic of Lithuania.
8. Prices of goods, payment procedure and terms
8.1. The prices of the goods in the online store and in the formed order are indicated in euros with VAT. Delicatum.lt reserves the right to change the prices of goods in case of changes in tax rates.
8.3. The buyer pays for the goods in one of the following ways:
8.3.1. Payment by bank transfer is a prepayment when the Buyer, after printing the order and going to the nearest bank branch, or simply using the online banking system, transfers money to one of the Delicatum.lt bank accounts.
8.3.2. Payment in cash upon delivery of the goods - The Buyer pays for the goods during their delivery (transfer - acceptance).
8.4. When paying by the method of payment provided for in Clause 8.3.1, the Buyer undertakes to pay immediately. In the above cases, only after receiving the payment for the goods, the preparation of the consignment of goods begins and the term for delivery of the goods begins to run.
9. Delivery of goods
9.1. The goods are delivered by the Seller or his authorized representative.
9.2. The Seller undertakes to deliver the goods to the Buyer within the terms specified in the descriptions of the goods. These terms do not apply in cases when the required goods are not in the Seller's warehouse and the Buyer is informed about the shortage of the goods ordered by him. At the same time, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to l Force Majeure Circumstances.
9.3. When ordering the goods, the buyer undertakes to indicate the exact place of delivery of the goods.
9.4. The buyer undertakes to accept the goods himself. In case he cannot accept the goods himself and the goods have been delivered to the specified address and on the basis of other data provided by the Buyer, the Buyer has no right to make claims to the Seller regarding delivery of the goods to the wrong entity.
9.5. During the delivery of the goods, the Buyer must check the condition of the shipment together with the Seller or his authorized representative. If the Buyer signs the invoice (bill of lading) or other document of delivery-acceptance of the consignment, it is considered that the consignment has been delivered in proper condition.
9.6. The delivery fee and more detailed information related to the delivery of goods are provided in the "Terms of delivery" section of the online store.
9.7. In the event that the Buyer, in accordance with these Rules, withdraws from the contract of sale, he shall be obliged to pay all direct costs of returning the goods to the Seller. The amount of these costs of the Seller shall be deducted from the refundable money paid to the Buyer for the goods.
9.8. If it is not possible to deliver the ordered goods in one shipment, then Delicatum.lt has the right to deliver the goods in several shipments.
9.9. In all cases, the Seller is released from liability for violation of the terms of delivery of goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the Buyer's control.
10. Product quality guarantee and expiration date
10.1. All products are covered by the manufacturer's warranty terms. If the product breaks during the warranty period, the repair is free of charge. The Seller does not provide warranty maintenance services for the goods, referring the Buyer to the center providing warranty service in each specific case.
10.2. The characteristics of each product sold by Delicatum.lt are generally indicated in the product description attached to each product.
10.3. The Seller is not responsible for the fact that the goods in the online store may not correspond in their color, shape or other parameters to the actual size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.
10.4. In the event that the Seller does not provide a guarantee of the quality of items for certain types of goods, the guarantee provided by the relevant legal acts shall apply.
10.5. The Seller undertakes to sell the goods to the Buyer in such a way that he has a real opportunity to use such goods until the end of the shelf life. In case of extremely short warranty periods, the goods in the online store are marked with a special warning sign.
10.6. More detailed information related to the warranty conditions of the goods is available in the section "Warranty obligations" of the online store Delicatum.lt.
11. Return and exchange of goods
11.1. Return and exchange of goods is carried out in accordance with the Minister of Economy's 2001 June 29 by order no. 217 “Rules for Return and Exchange of Items” approved by the Minister of Economy. August 17 by order no. 258 approved "Rules for the sale of goods and provision of services when contracts are concluded by means of communication".
11.2. The Buyer may exercise the right to return and exchange the goods within 7 (seven) working days from the day of delivery of the goods to him, informing the Seller thereof in accordance with the procedure provided for in Clause 4.2 of the Rules.
11.3. The returned goods must be in the original neat packaging, undamaged by the Buyer, without losing the appearance of the goods (undamaged labels, peeled protective films, etc. (this item does not apply in case of returning defective goods)), necessarily in the same configuration as received by the Buyer. purchase document and warranty card (if issued). In case the goods returned by the Buyer are sent to the Seller using the services of courier services, this product must be placed in the additional (protective) packaging before sending.
11.4. The Buyer can send the returned goods using courier services. In the event that the goods are returned in accordance with 4.2. the right provided for in paragraph, the Buyer shall bear the costs of returning the goods. When the wrong and / or defective goods are returned, the Seller undertakes to pick up such goods and replace them with similar suitable goods. In the event that the Seller does not have similar goods, he shall return to the Buyer the money paid for the goods.
11.5. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not follow the procedure for returning the goods set out in this Article.
12. Marketing measures applied by the seller
12.1. The Seller may, at its discretion, initiate various promotions in the Delicatum.lt online store, other Delicatum.lt managed outlets (stores), Delicatum.lt account on the social network Facebook and any other media.
12.2. The seller has the right to inform the buyer in advance s, by its unilateral decision to change the terms and conditions of the shares, as well as to cancel them, to change the procedure for providing Delicatum.lt virtual money and using it when paying for goods. Any changes (including cancellation) initiated by the Seller in the terms and conditions of the shares and the procedure for granting and using Delicatum.lt virtual money apply only to the future, i.e. valid from the moment of their performance.
12.3. The specific terms and conditions of certain shares initiated by the Seller, specific only to those specific shares, are defined in the communication means of these shares.
12.4. Cookies are small files that are temporarily placed on a user's hard drive to allow identification of the user's computer during other visits to websites. PSEE uses cookies only to collect information related to the use of the website. The data provided by cookies is anonymous and does not provide personal information. Web bacons or "trackers" as well as "clear gif" technology or "action tags" can be used on PSEE websites. Tracking technology allows PSEE to find out which visitor / user clicked on page elements (such as links and images) while browsing the PSEE page or using PSEE email. The data provided by the trackers is anonymous and not related to personal information, nor does it constitute personal information. The user can choose to disable cookies / beacons using their browser settings at any time.
13. Liability
13.1. The buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the consequences. By filling in the registration form, the buyer at the same time confirms that he is an adult and assumes all possible losses related to the challenge of this fact and the consequences arising from it.
13.2. The buyer is responsible for the actions taken using this online store.
13.3. The buyer is responsible for transferring his login details to third parties. If the services provided by Delicatum.lt are used by a third party who has logged in to the online store using the Buyer's login data, the Seller considers this person to be the Buyer.
13.4. The Seller is released from any liability in cases where the loss arises due to the fact that the Buyer, notwithstanding the Seller's recommendations and its obligations, did not read these Rules, even though he was given such an opportunity.
13.5. If the Seller's online store contains links to the websites of other companies, institutions, organizations or persons, the Seller is not responsible for the information or activities performed there, does not maintain, control and does not represent those companies and persons.
13.6. In the event of damage, the guilty party indemnifies the other party for the direct damage suffered.
14. Exchange of information
14.1. The Seller sends all notifications to the e-mail address provided in the Buyer's registration form.
14.2. The Buyer shall send all notices and questions by the means of communication specified in the "Contacts" section of the Seller's online store.
15. Final provisions
15.1. The law of the Republic of Lithuania shall apply to the relations arising on the basis of these rules.
15.2. Any disagreement arising from the implementation of these rules shall be settled by negotiation. If no agreement is reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania.
